The General Terms and Conditions of Sale set out below apply to all activities offered by R3-France, via its website www.r3-france.com.
Persons wishing to take part in training courses organised by R3-France fully and unconditionally accept the Terms and Conditions set out below.

Designation 
R3-France is a professional training organisation specialising in whitewater and flood rescue training.
R3-France designs, develops and delivers inter-company and intra-company training courses throughout France and abroad.
In the following paragraphs, the following terms are used

  • client: any natural or legal person who registers or orders a course from R3-France;
  • trainee: the natural person who takes part in a training course;
  • inter training: training courses listed in R3-France’s catalogue that bring together trainees from different organisations;
  • in-house training: training courses customised by R3-France for a client or a group of clients;
  • GTC: general terms and conditions of sale, detailed below;
  • OPCA: the approved joint collecting bodies responsible for collecting and managing the training effort of companies.

Subject 
These general terms of sale apply to all training services provided by R3-France on behalf of a Client. The fact of registering or placing an order implies the Client’s full and unreserved acceptance of these terms and conditions of sale. These general terms and conditions of sale prevail over any other document of the Client, and in particular over any general terms and conditions of purchase of the Client.

Sales prices
Training courses :
The prices of inter-company training courses are indicated in Euros and net of tax (VAT exemption in accordance with article 261.4.4°a of the CGI) on the Organisation’s communication media, the registration form, the estimate, the professional training agreement or the professional training contract.

In-house training :
The prices of in-house training courses are indicated in Euros and net of tax (VAT exemption in accordance with Article 261.4.4°a of the CGI) on the commercial proposal sent to the Client. Costs related to tools, room hire, travel and accommodation expenses for trainers are invoiced in addition.

Registration
Any order implies the Client’s unreserved acceptance of these general conditions of sale and participation. Unless expressly waived by the Training Organisation, these conditions prevail over any other document from the Client, and in particular over any general terms of purchase.
The trainee(s)’ registration will be validated upon receipt by R3-France of one of the following documents: registration form, professional training agreement, professional training contract or quotation, duly completed, and accompanied by a deposit representing 50% of the training amount.
The balance must be paid before the end of the course.

Responsibility
Any registration for one or more R3-France courses implies compliance with the establishment’s internal regulations. These rules are brought to the attention of the client and the trainees.
R3-France cannot be held responsible for any damage to or loss of objects and personal belongings brought by participants to the course. It is the client’s responsibility to check that their personal insurance covers them during their training.

Description and programmes of the training courses
The contents of the programmes, as they appear on the training data sheets, are provided for information only. The instructor or the person in charge of the training reserves the right to modify them according to the current situation, the level of the participants or the dynamics of the group and the climatic conditions.

Subcontracting
The Training Organisation is authorised to subcontract, in part or in full, the performance of the services covered by the contract. All the Client’s obligations arising from this are valid only with regard to the Training Organisation, which remains responsible, with regard to the Client, for all the obligations resulting from this contract.

Obligations and force majeure
In the context of its training services, R3-france is bound by an obligation of means and not of result vis-à-vis its Clients or Trainees.
R3-france cannot be held liable to its Clients or Trainees in the event of non-performance of its obligations resulting from a fortuitous event or force majeure. The following are considered fortuitous or force majeure events, in addition to those usually recognised by case law: illness or accident of a trainer or educational manager, strikes or industrial disputes external to R3-France, natural disasters, fire, interruption of telecommunications, energy supply or transport of any kind, or any other circumstance beyond the reasonable control of R3-France.

Cancellation or abandonment of training
Unless otherwise specified in the training agreements or contracts, the conditions for cancellation by the Customer or Trainee are as follows:
In the event of cancellation or abandonment of the training course by the Customer or its agents, less than 10 calendar days before the start of the training course or after the start of the training courses, the Customer shall pay the Service Provider compensation by way of a penalty clause equal to 100% of the remaining training price due.
These indemnities cannot be charged by the employer under its obligation defined by Article L.6331-1 of the French Labour Code, nor can they be the subject of a request for reimbursement or coverage by the OPCA.

Cancellation by the training organisation
R3-France reserves the right to cancel a course in the event of force majeure or to postpone a course with insufficient participants within 8 days of its start date. The client will be informed by e-mail. No compensation will be due for cancellation by R3-France. In the event of definitive cancellation of the course by R3-France, any advance payments received will be reimbursed. In the event of partial performance by R3-France, only the price of the partially performed service will be invoiced for the training.

Intellectual property and copyright
All the presentation sheets, content and teaching aids, whatever their form (paper, electronic, digital, oral, etc.) used by R3-France to provide training or given to Trainees, constitute original works and, as such, are protected by intellectual property and copyright.
As such, the Client and Trainee are prohibited from using, transmitting, reproducing, exploiting or transforming all or part of these documents without the express agreement of R3-france. This prohibition applies, in particular, to any use made by the Client and the Trainee for the purpose of organising or conducting training courses.

Disputes
If a dispute or difference cannot be settled amicably, the court of Chambéry shall have sole jurisdiction to settle the dispute.
